Governor Whitmer Extends Executive Order on Electronic Notarizations through September 30

LANSING, Mich. -- Governor Whitmer today signed Executive Order 2020-173, which extends her previous order allowing business to be conducted remotely by permitting expanded use of e-notaries and e-signatures.    

“Many Michiganders have done their part in the fight against COVID-19 by wearing a mask and practicing physical distancing. But COVID-19 is still a very real threat to our families, our frontline workers, and our economy. ,” Governor Whitmer said. “This executive order will protect more people during this ongoing public health crisis by reducing unnecessary interactions while providing a pathway for people to conduct business as usual.”  

Under Executive Order 2020-173, requirements for in-person notarizations are temporarily suspended and transactions that require a notary to be completed via two-way, real-time audiovisual technology are allowed. The order also permits the use of electronic signatures in all cases, except in rare circumstances when a physical signature is specifically required by statute. The order takes effect immediately and extends the validity of notary commissions through September 30, 2020.

Fighting the Spread of COVID-19 - Landlords

We’ve received quite a few questions on President Trump’s Executive Order - "Fighting the Spread of COVID-19 by Providing Assistance to Renters and Homeowners". This E.O. authorizes federal agencies, such as HUD and the Department of Health and Human Services, to review for implementation of any policies or measures that may assist renters and/or prevent evictions.  

Although it was initially reported as an extension of the federal eviction moratorium implemented by CARES that expired 7/25, it is not. Therefore, properties covered by CARES Act can still pursue their legal nonpayment remedies once any demands or notices issued pursuant to its guidance expire. (Likewise, non-CARES Act properties can still file in their normal course this month once the nonpayment demands expire.)

With that said, be mindful of the following:

• Further orders could be imminently forthcoming from federal agencies that could act as actual eviction moratoriums, similar to the existing one through August on FHA-insured single family homes. 

• Likewise, although to date there has not been a deal reached in Congress on another COVID-19 stimulus package, one could still be struck at any time and could include a formal extension of the CARES moratorium.

• States and/or local entities can still institute their own eviction moratoriums, such as what is currently in place in the city of Detroit.

• Local judges may misinterpret the terms of the Executive Order and be under the belief that the CARES moratorium has in fact been extended.
